      OWEN ASTON.
      Chambersburg, August 3, 1795.
The "Butler Negroes" of Maryland were hundreds of persons descended from the 1681 marriage of an enslaved Black man named Charles Butler and Eleanor "Irish Nell" Butler, a free white indentured woman. A 1664 colonial Maryland law mandated that Eleanor, by marrying an enslaved man, would herself become enslaved, as well as all of her children. The law was repealed by the Assembly at the urging of Lord Baltimore, but the repeal only took effect on the last day of the Assembly, so Nell and her husband remained enslaved and their enslavers remained owners of all their children and descendants. But since the children were born after the law was repealed, they questioned whether they should have been considered free. Between 1787 and 1791, hundreds of descendants filed more than ninety suits with the Maryland courts, and won every case. The fascinating story of these landmark rulings is summarized by William G. Thomas III in the article "Suing for Freedom," in Lapham's Quarterly Roundtable, https://www.laphamsquarterly.org/roundtable/suing-freedom, accessed 07 August 2024.

Notes: Butler was captured in Franklin County and placed in the county jail at Chambersburg on September 26, 1803.
      A NEGROE MAN,
WHO calls himself Jack Butler, on the 26th ultimo was committed to the Goal of Franklin county, on a charge of absconding from Thomas Bell of George Town, Maryland, but who now says he was sold by Mr. Bell to a person who was about to carry him, with several others, to the state of Georgia.
